GENERAL CONDITIONS OF USE

I. User:

Anyone who accesses and/or uses the dracemedioambiente.com website fully accepts from that moment without reservation the particular terms and conditions that, where appropriate, complement, modify or substitute the general conditions related to specific services and contents of the website.

II. Use of the website, its services and contents::

The user agrees to use the website and its services and contents in good faith for the purposes generally accepted without infringing current Law or disturbing public peace and order.
Furthermore, it is forbidden to use the Web for reasons that are illicit or damaging to DRACE Medioambiente, S.A., or to any third party or in any way or form that could be detrimental to the website or impede its normal functioning.
Concerning the content (information, texts, graphs, sound and/or image files, photographs, designs, etc.), the following are forbidden:

- Reproduction, distribution or modification thereof without the authorization of its legitimate owners.
- Any infringement of the rights of DRACE Medioambiente, S.A., or of the legitimate owners of same.
- Its use for commercial or advertising purposes of any type other than that strictly permitted.
- Any intent to obtain the contents of the website by any means other than those placed at the disposal of the users as well as those normally
  used on the network, providing they do not harm the website of DRACE Medioambiente, S.A.

III. Unilateral modification:

Without previous notice, DRACE Medioambiente, S.A., can unilaterally change the structure and design of the website as well as modify or eliminate the services, contents and access conditions and/or use of the website.

IV. Hyperlinks:

The establishment of any type of hyperlink between a web page and any of the web pages of the website of DRACE Medioambiente, S.A., shall be subject to the following conditions:

- It is forbidden to reproduce part or all of the services or contents of the website of DRACE Medioambiente, S.A.
- No deep-links will be established with the web pages of the website or with its services nor will a browser or a border environment be created thereto.
- The web page to which a hyperlink is established will not contain any brand marks, trade names, notices of establishment, name designations, logos, slogans or other distinctive signs, symbols or marks belonging to DRACE Medioambiente, S.A.
- Under no circumstance will DRACE Medioambiente, S.A., be held responsible for the contents or services placed at the disposal of the public in the webpage connected to its website by a hyperlink or of the information and/or statements included therein.

V. Exclusion of guarantees and responsibilities:

In no case does DRACE Medioambiente, S.A., authorize any guarantees or take responsibility for any damages of any type that result from:
- Non availability, maintenance and effective working of the Web and/or of its services or contents.
- Lack of utility, suitability or validity of the Web and/or its services or contents to satisfy the needs, activities or specific results or expectations of the users.
- The existence of viruses, malicious or damaging programs in the contents.
- Reception, obtainment, storage, distribution or transmission of the contents by users.
- Illicit, negligent and/or fraudulent use of these General Terms and Conditions, in good faith, to the generally accepted uses or public order, of the Website, its services or contents by the users.
- Lack of lawfulness, quality, usefulness and availability of the services provided to third parties and placed at the disposal of users of the Website.
- Non-compliance by third parties with their obligations or commitments in relation to the services provided to users through the Website.

VI. Duration:

The duration of the lending of services of the Website and of the services is of an undefined nature.
Without prejudice to the above, DRACE Medioambiente, S.A., reserves the right to interrupt, suspend or terminate the lending of services of the Website or any of the services forming part thereof, under the same terms that are set forth in the third condition hereof..

VII. Intellectual Property

For the purpose of preserving possible intellectual property rights, if any user or third party believes that his or her legitimate rights have been violated by introducing any specific item on the Web, he or she should notify this circumstance to DRACE Medioambiente, S.A., indicating the following:
- Personal data of the party holding the rights that have presumably been infringed upon. If the claim is presented by a third party different from the interested party, he should indicate the representation with which he acts.
- The contents protected by the intellectual property rights and location on the Web.
- Accreditation of the mentioned intellectual property rights.
- Specific statement by the interested party assuming the responsibility for the veracity of the information provided in the notification.

The legitimacy of the intellectual or industrial property rights corresponding to the contents provided by third parties is of their exclusive responsibility.

VIII. Applicable legislation and jurisdiction:

These General Terms and Conditions shall be governed by Spanish Law.

DRACE Medioambiente, S.A., and the user, expressly waving their rights to any jurisdictions that might correspond to them, shall submit to the jurisdiction of the Courts of the address of the user.
